1. Agreement to Terms

By accessing or using Tipo ("Service") at heytipo.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Tipo is a social media management platform that allows you to schedule and publish content to connected social accounts (e.g., Instagram, Facebook, TikTok, LinkedIn, X, YouTube), manage media assets, view a content calendar, and use automation and analytics features. We do not guarantee availability of any third-party platform or API.

3. Account and Eligibility

You must create an account to use the Service. You must be at least 18 years old and have the authority to bind yourself or your organization to these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Acceptable Use

You agree not to use the Service to: (a) violate any applicable law or third-party terms (including platform policies); (b) post illegal, harmful, or offensive content; (c) impersonate others or misrepresent your affiliation; (d) interfere with or disrupt the Service or our systems; (e) attempt to gain unauthorized access to any part of the Service or other accounts; or (f) use the Service for spam or abusive automation. We may suspend or terminate your access for violations.

5. Your Content and Licenses

You retain ownership of content you create or upload. By using the Service, you grant us a limited license to use, store, and transmit your content as necessary to provide the Service (e.g., posting to connected platforms at your direction). You are responsible for ensuring you have the rights to all content you submit.

6. Third-Party Platforms

Connecting social accounts is subject to each platform's terms and policies. We are not responsible for third-party platform actions, rate limits, or policy changes. You may disconnect accounts at any time from your account settings.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIPO AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR $100 IF GREATER).

9. Termination

You may close your account at any time. We may suspend or terminate your access for breach of these Terms or for any reason with notice where practicable. Upon termination, your right to use the Service ceases. Sections that by their nature should survive (e.g., disclaimers, limitation of liability) will survive.

10. Changes to Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may be communicated by email or in-app notice. Continued use after changes constitutes acceptance. If you do not agree, you must stop using the Service.

11. General

These Terms constitute the entire agreement between you and Tipo regarding the Service. If any provision is held invalid, the remainder remains in effect. Our failure to enforce any right does not waive that right. These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
